With the guidelines, the government clarified that the service charge is completely illegal in India. Now hotels/restaurants shall not add service charge in the food bill. No hotel or restaurant shall force a consumer to pay service charge and shall clearly inform the consumer that service charge is voluntary, optional and at consumer’s discretion. Hotel-Restaurant Service Charge: The Ministry of Consumer Affairs, Food & Public Distribution on Thursday said the DoCA will soon come up with a robust framework to ensure strict compliance by the stakeholders with regard to service charges levied by restaurants and hotels.
In restaurants across the country, customers are asked to add service charge to the food bill. The Department of Consumer Affairs of the Central Government (DOCA) in a meeting held today with the National Restaurant Association of India (NRAI), has asked not to collect service charge. The government said that taking service charge forcibly is an Unfair Trade Practice on which NRAI argued and said that the government should not get involved in the service charge case.
