Govt clears stand on Vodafone arbitration case appeal after 'speculative' report

The Ministry of Finance today set the record straight on the Vodafone tax arbitration ruling issue saying that all options are being considered by the government on the matter of appealing against the verdict of the international tribunal. The government was in the process of examining all options and further course of action will be decided “on such examination” a government release said. 

Calling the news that claimed that Attorney General has given an opinion in favour of not appealing in the Vodafone Arbitration award as “speculative news story”, it said that the report was “totally incorrect and without any factual basis”. 

A report published on Thursday claimed that “The country’s top law officer does not want the government to challenge the Vodafone tax arbitration ruling by an international tribunal at another forum.” 

This follows in the wake of the 25 September international arbitration order in Vodafone Group Plc case. It was won by Vodafone. The tax dispute in India had been pending for a long time. The two parties went for arbitration to an international arbitration tribunal in The Hague.

Later on that day, the Finance Ministry came out with a statement which said, “It has just been informed that the award in the arbitration case invoked by Vodafone International Holding BV against Government of India has been passed.  The Government will be studying the award and all its aspects carefully in consultation with our counsels. After such consultations, the Government will consider all options and take a decision on further course of action including legal remedies before appropriate fora."
