Motor Vehicle insurance Policy Alert! Your accidental cover claim may be rejected by insurers; check this IRDAI circular

Motor Vehicle insurance policyholders in Delhi-NCR should know that just getting their vehicle policy renewed on time is not enough. The Insurance Regulatory and Development Authority (IRDAI) latest circular dated 20th August 2020 has made it mandatory for the vehicle insurance policyholders to renew their pollution certificate on time. Failing which, general insurance companies will deny their insurance claim after any accident.

In its circular dated 20 August 2020, the IRDAI said, "This has reference to the Authority’s Circular No. IRDA/NL/CIR/MISC/104/ 07/2018 dated 06th July, 2018 advising all general insurance companies to comply with the direction issued by Hon’ble Supreme Court of India in Writ Petition (Civil) No.13029 of 1985 in M.C. Mehta Vs. Union of India and Others. Central pollution control board (CPCB) has raised concerns regarding status of compliance of above direction of Hon’ble Supreme Court of India in National Capital Region of Delhi (Delhi – NCR)." 

The IRDAI circular requested the vehicle insurance policyholder to ensure that the direction of Supreme Court of India is followed scrupulously with special focus on compliance in National Capital Region of Delhi (Delhi – NCR).

This IRDAI step is in sync with the Supreme Court orders on pollution control case in Writ Petition (Civil) No.13029 of 1985 in MC Mehta Vs Union of India and Others. The Supreme Court of India had delivered its verdict after hearing the Writ Petition that vehicle insurance claims should be denied to those vehicle insurance policyholders who have not renewed their pollution certificate on time.
