The Ministry of Electronics and Information Technology (MeitY) has implemented the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, under the Information Technology Act, 2000. These rules prohibit the uploading, publishing, or sharing of information on any platform that violates the law. According to the IT Rules, 2021, platforms that fail to comply will lose the immunity provided under Section 79 of the IT Act, making them accountable for third-party content.
Ban on Misleading Advertisements
On March 6, 2024, the Central Consumer Protection Authority (CCPA) issued an advisory banning advertisements that promote illegal activities. The advisory specifically prohibits the advertisement, promotion, and endorsement of such activities in violation of various laws.
Stricter Regulations on Online Betting Platforms
On March 21, 2024, the Ministry of Information and Broadcasting (MIB) issued an advisory to media outlets, including social media platforms, prohibiting the publication and broadcast of online betting advertisements. Media intermediaries were also advised against displaying such ads to Indian audiences.
Consumer Complaint Resolution
To safeguard consumer rights, the Department of Consumer Affairs has established a three-tier judicial system under the Consumer Protection Act, 2019, with forums at the district, state, and national levels. These forums provide fast and accessible solutions for consumer complaints.
Under the IT Rules, 2021, every intermediary must appoint a Grievance Officer to handle consumer complaints in a timely manner. If a consumer is dissatisfied with the resolution, they may appeal to the Grievance Appellate Committee within 30 days.
Consumer Protection in E-Commerce
In 2020, the Department of Consumer Affairs also introduced the Consumer Protection (E-Commerce) Rules, which aim to protect consumers from fraud and unfair business practices in e-commerce. These rules make e-commerce platforms responsible for addressing consumer complaints.
Cybercrime and Security
The Ministry of Home Affairs (MHA) has established the Indian Cyber Crime Coordination Centre (I4C) to tackle cybercrimes and improve coordination among law enforcement agencies. Additionally, the National Cyber Crime Reporting Portal (https://cybercrime.gov.in) has been launched to allow individuals to report cybercrimes.
Through these efforts, the government aims to strengthen consumer protection, enhance online security, and ensure a safer digital environment for all.
