Giving a blow to Maharashtra's decision to implement 10 per cent EWS quota in PG medical courses for the academic year 2019-20, the Supreme Court today said the EWS quota cannot be granted at the cost of others unless additional seats are created by the Medical Council of India. According to report, a vacation bench of Chief Justice Ranjan Gogoi and Justice Aniruddha Bose also noted that admission process for PG medical courses started in November 2018, while the 103 Constitutional amendment granting 10 per cent EWS quota was passed in January 2019.

"Ten per cent EWS quota cannot be granted to the ongoing admission process. You cannot change the rules of game when the game is on," the bench was quoted as saying by PTI report. 

The court order came on a plea filed by a student Rajat Rajendra Agrawal from General Category who submitted that unless additional seats are created, the ten per cent EWS quota will eat into their share of seats.

Gujarat implements EWS quota in admissions

On Wednesday, the Gujarat government gave approval to implementation of 10 per cent EWS quota in admissions to professional and medical courses from this academic year, and addition of seats to accommodate the new reservation. Gujarat has become the first state in the country to implement the quota. This creation of new seats for various professional courses was approved during a cabinet meeting chaired by Chief Minister Vijay Rupani.

Accordingly, 6,800 new seats in various medical and allied courses, and around 44,000 new seats in engineering, pharmacy, architecture and other professional courses will be addded from this year.

EWS quota in Delhi govt jobs

Delhi government's Services department has also issued directions to implement 10 percent reservation for economically weaker sections in all direct recruitment effective from February 1 this year. In a circular of Services department, dated May 28, issued by deputy secretary (services) Biju Raj on behalf of the competent authority (Lt Governor), all the departments and other bodies of the Delhi government have been asked for compliance of the quota provision, according to a Delhi government circular.

The circular stated, "This is for compliance by all the departments, Corporations, Boards, Public Sector Units and Autonomous Bodies of Government of National Capital Territory (GNCTD) of Delhi."
