According to an ANI report, the bench headed by Justice AM Khanwilkar consented to consider the plea for granting 'opt out' for students who will not be able to appear for the exams due to the COVID-19 restrictions. The bench further observed, "We are not stopping the exam. We are going to consider how opting out can be granted. In the midst of exams, out of five papers, if a student appears for three papers, he should be appearing in two papers only next time."
The bench had posted for today the hearing of the plea seeking directions of an 'opt out' option' to the candidates willing to appear in the upcoming CA exams, who are willing to opt out before and during the exam. The apex court has further asked the ICAI to provide details on the SOPs that will be maintained at the exam halls today, ANI said in its report.
On Monday, ICAI submitted to the court that for the best interest of the students, the ICAI CA exams should be conducted in July instead of postponing it further, this report said. ICAI also pointed out that the exams were scheduled to take place in the month of May, but they had to be postponed to July due to the rise in the number of COVID-19 cases. ICAI has also submitted that since the COVID-19 third wave will peak in September-October, the exams should be allowed to take place in July.
There are three pleas before the apex court seeking relief for the ICAI CA exams due to COVID-19, ANI report said. One of the pleas sought direction to give extra chance, opt out option to the students appearing for intermediate and final CA exams under old syllabus, this report said.
