Whats in a name? IndiGo alleges trademark infringement by M&M; SUV maker doesnt see a conflict

Mahindra & Mahindra has initiated discussions with InterGlobe Aviation, the parent company of IndiGo airlines, to amicably resolve a trademark dispute over the use of "6e" in its new electric vehicle branding.
The automaker recently unveiled two electric SUV models, BE 6e and XEV 9e, and clarified that its trademark "BE 6e" significantly differs from IndiGo's "6E," which serves as the airline's designator code.
“We have taken on board the concerns raised by InterGlobe Aviation regarding potential infringement of their goodwill, which was not our intention. We are engaged in discussions with them to find an amicable solution,” Mahindra said in an official statement.
IndiGo, however, has asserted the significance of its trademark. "The '6E' mark is an integral part of IndiGo’s identity for the past 18 years and is a registered trademark that holds strong global recognition. The '6E' mark, whether standalone or in its variants and formative forms, is extensively used by IndiGo for its offerings and for goods and services provided in collaboration with trusted partners. Any unauthorised use of the '6E' mark, whether standalone or in any form, constitutes an infringement of IndiGo’s rights, reputation, and goodwill. IndiGo is committed to taking all necessary and appropriate steps to safeguard its intellectual property and brand identity," the airline said in a statement.
Mahindra argued that its trademark falls under Class 12 for vehicles, distinguishing it from IndiGo's aviation trademark. "We don’t see a conflict as Mahindra’s mark is 'BE 6e,' not the standalone '6E.' It fundamentally differs from IndiGo’s '6E,' representing an airline, eliminating any risk of confusion. Additionally, the distinct styling underscores their uniqueness,” the automaker stated.

IndiGo has reportedly filed a lawsuit and sought relief from the court’s intellectual property division regarding the matter. Both parties are working toward resolving the issue, with no immediate resolution in sight.
